These General Terms and Conditions of Sale (hereinafter referred to as the "General Conditions") govern the purchase of products made remotely through the website www.elgoncosmetic.com (hereinafter referred to as the "Website").

Acceptance of the General Terms and Conditions of Sale

All purchases of Products made through the Website by users accessing it (hereinafter referred to as the "Customers") are governed by these General Conditions, as well as by the Italian Consumer Code (Legislative Decree No. 206/2005) and the Italian regulations on electronic commerce (Legislative Decree No. 70/2003).

By completing a Purchase Agreement in accordance with the prescribed procedure, the Customer acknowledges, accepts, and agrees to comply with these General Conditions.

Customers are therefore required to carefully read these General Conditions before making any purchase. Pidielle S.p.A. makes them available to Customers in order to allow their reproduction and storage, in compliance with Article 12, paragraph 3 of Legislative Decree No. 70/2003.

Pidielle S.p.A. reserves the right to amend the content of these General Conditions at any time and without prior notice. The General Conditions published on the Website at the time the Customer submits the purchase order shall apply to each individual Purchase Agreement. Customers may save a copy of the applicable General Conditions in PDF format or retain the order confirmation email, which includes the relevant terms and conditions as an attachment.

Products

www.elgoncosmetic.com (hereinafter referred to as the “Website”) is an e-commerce platform offering cosmetics, hair care beauty products, and related accessories exclusively under the ELGON COSMETIC brand (hereinafter referred to as the “Products”).

All Products offered for sale are described in detail on the Website within their respective sections and categorized according to product type, in compliance with the provisions of the Italian Consumer Code.

The visual representation of the Products on the Website, where available, is provided for illustrative purposes only and generally corresponds to photographic images of the Products. Such images are intended solely to present the Products for sale and do not constitute any guarantee or commitment by Pidielle S.p.A. regarding the exact correspondence between the images displayed on the Website and the actual Products, particularly with regard to their dimensions, colors, or packaging.

In the event of any discrepancy between the Product image and the written Product description, the Product description shall prevail.

Customers are not permitted to sell or resell Products purchased through the Website. Pidielle S.p.A. reserves the right, at its sole discretion, to suspend, revoke, or limit supplies if it reasonably believes that the Customer may be in breach of this provision.

Purchase Procedure

Customers may purchase the Products included in the ELGON COSMETIC electronic catalog, which are described in detail on the Website within the relevant product category sections and in the corresponding product information sheets, by following the technical procedures indicated on the Website.

Customers may first register on the Website by providing the required personal information and following the registration instructions. They must then complete and submit the electronic order form available on the Website, following the instructions provided therein. Purchase orders must be completed accurately and in their entirety.

Customers who choose not to register on the Website may still complete the purchase process; however, they will not be able to monitor the status of their orders or benefit from discounts and promotional offers.

The Customer must place the selected Products in the designated “Shopping Cart” and, after selecting the preferred shipping option and accepting the applicable delivery charges, may proceed with the purchase.

Should the Customer need to modify the purchase order or any information contained therein, they must follow the relevant modification procedure available on the Website. In particular, Customers may change the quantity of Products they wish to purchase and may add or remove one or more Products from the Shopping Cart.

Once this process has been completed, the Customer will be shown an order summary page, including delivery costs, and will be asked to confirm the purchase procedure.

After reviewing the order summary, the Customer must select the preferred payment method, including PayPal, Shopify Payments, bank transfer, cash on delivery, or—where available—Gift Card, and submit the order by clicking the designated confirmation button.

Contract Conclusion

The publication of Products displayed on the Website constitutes an invitation for the Customer to submit a contractual purchase offer. The order placed by the Customer shall be considered a contractual offer and implies full knowledge and acceptance of these General Conditions.

Each Purchase Agreement entered into between Pidielle S.p.A. and the Customer shall be deemed concluded when Pidielle S.p.A. sends its order acceptance to the Customer’s email address. This confirmation email will include an “Order Number,” to be used in all future communications with Pidielle S.p.A. The message will also include, in addition to the legally required information, all data provided by the Customer, who undertakes to verify its accuracy and promptly communicate any corrections. Any additional costs resulting from errors in the data not promptly reported shall be borne exclusively by the Customer.

Each order may be viewed by the Customer on the Website, in their personal account area if registered, or by contacting the Pidielle S.p.A. Customer Service immediately after submitting the order.

Occasionally, product availability issues may occur. In such cases, if the Products selected by the Customer are partially or entirely unavailable, Customer Service will contact the Customer via email, and the Customer may choose to cancel the order, wait until the Products become available again, or receive only the available Products. In the latter case, a partial order will be fulfilled, and Pidielle S.p.A. undertakes to ship the missing Products at its own expense.

Pidielle S.p.A. reserves the right not to accept purchase offers and to cancel orders that do not provide sufficient guarantees of solvency, or where—following checks with the payment card processing system—anomalies are detected in the transactions or payment methods used by the Customer. In such cases, the Customer will be promptly notified by email.

Product Prices

All Product prices are clearly indicated on the Website in accordance with Article 13 et seq. of the Italian Consumer Code and are inclusive of VAT. Delivery costs are clearly displayed at the time of ordering. Shipping costs may vary depending on the delivery method, payment method, destination, and the total order amount.

Invoicing and Payment Methods

Pidielle S.p.A. issues a receipt or, upon request, an invoice for the purchased Products at the time the Products are handed over to the courier for shipment, sending it to the Customer via email. The information provided by the Customer shall be used for invoicing purposes. No changes to the data will be possible after the invoice has been issued.

As detailed below, payments made via PayPal require only an authorization or pre-authorization of funds, without actual charge at the time the Customer places the order. The payment is therefore effectively charged only when the Products are delivered to the shipping courier. At this stage, Pidielle S.p.A. will also issue the invoice related to the order.

Payment for purchased Products can be made via PayPal, Shopify Payments, bank transfer (if available), or Gift Card, according to the methods described below.

Bank Transfer

Once the order has been completed and bank transfer selected as the payment method, the Customer is required to make the payment using the following bank details:

Once the bank transfer has been completed, the Customer must send proof of payment to the following email addresses: amministrazione@elgoncosmetic.it and customer@elgoncosmetic.it

The order will be processed according to the timing of payment receipt.

PayPal

Once the order has been completed and PayPal selected as the payment method, the Customer will be redirected to the PayPal website, where they can log in using their email address and password. By choosing PayPal, the amount is charged directly to the linked credit card (Visa, Visa Electron, Mastercard, American Express) or prepaid card (PostePay).

PayPal protects the Buyer’s information as no financial details are shared with the Seller. An email confirmation is sent by PayPal for each transaction. The order amount is charged to the PayPal account when the order is taken over by the courier. At the time of order placement on the Website, only an authorization request is made to verify the availability of funds in the Customer’s PayPal account, with no actual charge. In case of order cancellation, the amount is refunded to the Customer’s PayPal account.

Gift Card

The Customer may pay using a “Gift Card” by selecting Gift Card as the payment method in the cart and, after selecting the shipping method, entering the number shown under the barcode and the security code.

Shopify Payments

When payment is made by credit card, the Customer will be redirected to a secure website, and credit card details will be transmitted directly to Shopify Payments, the payment processor acting on behalf of the Seller. The transmitted data is sent securely using 128-bit SSL (Secure Socket Layer) encrypted technology. Such data is not accessible even to the Seller.

Pidielle S.p.A. shall not be held responsible for any delay and/or failure in product delivery if the issuing bank of the Customer’s credit card refuses or does not authorize the payment.

Delivery Methods and Shipping Costs

Pidielle S.p.A. undertakes to deliver the goods without undue delay and in any case no later than thirty (30) days from the conclusion of the contract. Products will be delivered via courier, and delivery times may vary depending on the destination. Delivery times indicated at the time of ordering are for reference only.

Pidielle S.p.A. delivers exclusively within Italian territory, and shipments are made via courier service without appointment scheduling.

No liability of any kind may be attributed to Pidielle S.p.A. for delays in order processing or delivery of Products under the Purchase Agreements.

Ordered Products will be shipped to the postal address provided by the Customer.

Deliveries are made from Monday to Friday during normal business hours, excluding public holidays, according to the courier’s procedures. Delivery is considered completed when the Product is made available to the Customer at the address specified in the order form. In case of unsuccessful delivery due to the recipient’s absence, the courier will leave a notice and attempt a new delivery according to its procedures. If the new delivery attempt is unsuccessful due to continued absence, the courier’s Customer Service will attempt to contact the Customer to arrange an additional delivery. If Customer Service is unable to contact the Customer within the following 10 days, or in case of further delivery failure due to absence, the Products will be returned to Pidielle S.p.A. The Customer shall be entitled to request a refund of the total amount paid.

Upon delivery of the Products by the courier appointed by Pidielle S.p.A., the Customer is required to carefully check:

a) That the packaging is intact, undamaged, and has not been altered;
b) That the number of packages delivered corresponds to what is indicated in the delivery document.

Any damage to packaging or Products, or discrepancies in the number of items/packages or indications, must be immediately reported by the Customer, who may contact Pidielle S.p.A. Customer Service at customer@elgoncosmetic.it, specifying the order concerned.

Cases of force majeure, unavailability of transport means, or unforeseen or unavoidable events that cause delays in delivery, make delivery difficult or impossible, or significantly increase delivery costs for Pidielle S.p.A., shall entitle the company to split, postpone, or cancel, in whole or in part, the delivery, or to terminate the Purchase Agreement. In such cases, Pidielle S.p.A. shall promptly inform the Customer via email of its decision, and the Customer shall be entitled to a refund of any amount already paid, excluding any further claims against Pidielle S.p.A. of any kind.

Discount Vouchers – Promotions

Any discount vouchers or promotional codes may be entered by the Customer during the order checkout process. The system will automatically update the total order amount by deducting the value of the voucher.

The discount voucher may be combined with other commercial initiatives only where expressly stated.

Right of Withdrawal

RIGHT OF WITHDRAWAL: If the Customer is not satisfied with the product or if products delivered do not conform to the order, the Customer has the right to withdraw from the contract without providing any reason within 14 days from the date of receipt of the Products. The right of withdrawal may only be exercised by the person who placed the order (the invoice holder), and not by any other person who may have received the delivery.

Returns are subject to acceptance of the product by Pidielle S.p.A. in Parabiago. To initiate a return, the Customer must contact Customer Service at customer@elgoncosmetic.it providing the following information:

  • First name

  • Last name

  • Order reference number

The Customer will then be required to send the product back to Pidielle S.p.A.

Returns of items without following the above procedure will not be accepted. It is recommended to ship the return package via registered mail with return receipt.

CONDITIONS FOR RETURN ACCEPTANCE

To accept a return, we must ensure that the product has not been used and has not suffered any type of damage. Returned products must be shipped within 14 days from the delivery date in their original packaging or, if damaged, in packaging of equivalent size and strength. A refund will only be issued if all these conditions are met. Shipping and handling costs are non-refundable.

RETURN SHIPPING COSTS

In the event of withdrawal from a purchase, return shipping costs are borne by the Customer. Even in cases where a product is returned for replacement, exchange, or because it does not conform to the order or is defective (provided it has not been used), return shipping costs remain the responsibility of the Customer. Once the return has been verified and accepted as defective or damaged, return shipping costs will be borne by Pidielle S.p.A.

REFUND PROCESS

Once the returned products have been received and all requirements have been verified, we will send a confirmation email to the Customer and proceed with the refund to the credit card used for the original purchase. For credit card payments, the time required to see the refund depends on the Customer’s banking institution. The value date of the refund will in any case be the same as the original charge.

Non-Conformity of Products and Defective Items

The Products offered on the Website comply with national and EU legislation. Images and colors of Products shown on the Website may differ from the actual products due to local system settings and/or display devices used.

In case of non-conformity between the purchased Products and the description provided on the Website, or in the case of defective or faulty Products, the Customer is entitled to an immediate refund of the non-conforming item, provided that photographs evidencing the damage or non-conformity are sent via email to customer@elgoncosmetic.it.

The Pidielle S.p.A. team will then provide instructions regarding the refund method, which may, at the Customer’s discretion, also be issued in the form of discount vouchers for a future purchase, exceeding the value of the refunded goods, without prejudice to any further liability of Pidielle S.p.A.

In any case, the legal warranty provisions for conformity of goods set out in the Italian Consumer Code (Legislative Decree 206/2005, Part IV, Articles 102–135) remain unaffected.

Communications and Complaints

All communications or any complaints from the Customer towards Pidielle S.p.A. relating to the Purchase Agreements must be sent exclusively by email to customer@elgoncosmetic.it.

Intellectual Property Rights

All trademarks (registered or unregistered), as well as any and all works of authorship, distinctive signs or names, images, photographs, written or graphic texts, and more generally any other intangible assets protected by laws and international conventions on intellectual and industrial property rights displayed on the Website remain the exclusive property of Pidielle S.p.A. and/or its licensors. No rights whatsoever are granted to the Customer as a result of accessing the Website and/or entering into Purchase Agreements.

Any use, even partial, of such materials is strictly prohibited without the prior written authorization of Pidielle S.p.A., which retains all exclusive rights.

Applicable Law and Jurisdiction

These General Terms and Conditions and any contract concluded with the Customer shall be governed by Italian law, without prejudice to the application of European Union regulations and international treaties where applicable, as well as national consumer protection legislation.
